MYDAYDAYBELGIUMS PRIVACY POLICY STATEMENT (PPS)
This document describes the PPS of MyDayDayBelgium. It affects all data gathered and processed by MyDayDayBelgium. This policy is a derivative of the GDPR, and is to be applied to MyDayDayBelgiums activities and services, and MyDayDayBeligums data processing and data and information systems.
General Data Protection Regulation (GDPR)
The GDPR is EU Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. It repeals Directive 95/46/EC. The GDPR came in force on 25 May 2018. More information can be found on the EC GDPR site (https://ec.europa.eu/info/law/law-topic/data-protection_en) or on the site of the data protection authority (DPA) for Belgium (https://www.dataprotectionauthority.be/citizen).
MyDayDayBelgium takes its customer’s privacy seriously and will only collect personal information as outlined below.
MyDayDayBelgium shall therefore only use the customer’s name and other information, which relates to him in the manner set out in this PPS. Information will only be collected where it is necessary to do so and MyDayDayBeligum will only collect information if it is relevant to its dealings with the customer.
The customer is invited to read this PPS carefully before using this website. By using this website, the customer agrees with this PPS.
§1 – GENERAL PRINCIPLES
1.1 MyDayDayBelgium is a Belgian company registered at the Crossroads Bank for Enterprises under the number 0756.917.328, which operates an online blog and sales platform through www.mydaydaybelgium.com, (hereinafter called the « Website ») and gathers personal data (herein after referred to as « Personal Data») via several data and information systems. MyDayDayBelgium is the owner and processor of this data and does not pass on non-public data to third parties.
1.2 All Personal Data collected by MyDayDayBelgium are processed in compliance with the European and Belgian regulations applicable to the protection of Personal Data and in particular with the EU General Data Protection Regulation (GDPR).
1.3 The customer can contact MyDayDayBelgium for questions concerning private data and how MyDayDayBelgium makes use of it through e-mail at enquiry@mydaydaybelgium.com.
1.4. Complaints concerning the PPS of MyDayDayBelgium, or concerning unlawful data processing by MyDayDayBelgium, can be addressed to the Data Protection Authority (DPA) for Belgium (www.dataprotectionauthority.be). If there is a data breach, MyDayDayBelgium is bound to inform the DPA within 72 hours after becoming aware of it, and affected users – if identifiable – will also be notified, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.
§2 – SCOPE
2.1 This PPS explains MyDayDayBelgiums data processing practices and how MyDayDayBelgium uses any visitor’s information or Personal Data.
2.2 The PPS applies to all services provided by MyDayDayBelgium via the Website.
§3 – COLLECTED DATA
3.1 MyDayDayBelgium may collect, use, store and transfer different kinds of information (Personal Data) that can be grouped as follows:
- Identity Data: includes first name, last name, preferred pronoun, date of birth, gender, username or similar identifier, title;
- Contact Data: includes billing address, delivery address, e-mail address and telephone numbers;
- Correspondence Data: includes details of the customer’s correspondence with MyDayDayBelgium;
- Financial Data: includes bank account, payment card details;
- Transaction Data: includes details about payments to and from the customer and other details of products the customer will purchase, as well as details of the customer’s insurance if applicable;
- Technical Data: includes internet protocol (IP) address, the customer’s login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices used to access this Website;
- Profile Data: includes the customer’s username and password, purchases or orders made by the customer, the customer’s interests, preferences, feedback and survey responses;
- Usage Data: includes information about how the customer uses the Website and products (including the data obtained from cookies, web logs and other similar technologies that monitor the use of the Website);
- Marketing and Communications Preferences Data: includes the customer’s preferences in receiving marketing from MyDayDayBelgium and its third parties and the customer’s communication preferences.
3.2 This Personal Data may be collected by MyDayDayBelgium in several ways which reflect the legal basis applying to processing of the customer’s data:
3.2.1 Data provided by the customer, user of the Website in order to allow MyDayDayBelgium and its partners to proceed and fulfil the customer’s orders.
The personal information that will be collected will be used in some or all of the following ways:
(i) To deliver the purchased products ;
(ii) To update the customer on the delivery of the product and for the customer’s support purposes;
(iii) To provide the customer with relevant product information;
(iv) To process the customer’s orders and to provide him with the services and information offered through the Website/Apps requested by the customer;
(v) To verify and carry out financial transactions in relation to payments the customer makes online.
3.1.2 Data collected via technological tools. When the customer uses the Website, the computer system may collect Technical Data. Also cookies are being used in order to make the use of the Website attractive and facilitate the use of specific functions. MyDayDayBelgium also intends to use Google Analytics, a web analytics service that uses cookies. These are text files that are stored on the customers computer/and other devices and enable Google to analyze how the customer uses the Website.
§ 4 – PURPOSE OF THE DATA PROCESSING
4.1 The collected Personal Data is used to process the execution and follow-up of the customer’s Orders (performance of the contract). In addition, the Personal Data collected is used to improve the services of MyDayDayBelgium and to let it know the customers interests with regard to the functionalities, the performances and the support of its services.
4.2 The collected Personal Data may be used and processed by MyDayDayBelgium itself or via several supports for the purposes of promotional, commercial or information communications. In this context, in order to ensure a better use of its services and to keep the customer informed about MyDayDayBeligums news and its best offers, MyDayDayBelgium may offer its newsletters for free. Unless the customer notifies his objection, MyDayDayBelgium is entitled to send the customer via e-mail information regarding the use of its services and its promotional offers.
4.3 In addition, MyDayDayBelgium may use the Personal Data collected to carry out studies aimed at improving its services.
4.4 Where it is necessary to enable MyDayDayBelgium to execute the orders of the customer, it may transfer the Personal Data of the customer to third parties (for example: data may be transferred to the bank, payment card system operators, shippers, warehouses, insurers, catalogue and direct marketing fulfilment and distribution). These third-party providers will only collect, use and disclose the customer’s information to the extent necessary to allow them to perform the services they provide to MyDayDayBelgium. However, certain third party service providers, have their own privacy policies in respect to the information that is required to provide to them for the customer’s purchase-related transactions. For these providers, it is recommended that the customer reads their privacy policies so he can understand the manner in which his personal information will be handled by these providers.
In particular, the customer is reminded that certain providers may be located in or have facilities that are located in a different jurisdiction. So if the customer elect to proceed with a transaction that involves the services of a third party service provider, then the customer’s information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
4.5 Personal Data may be disclosed if necessary in order to (a) respect the applicable laws or satisfy a Court order or injunction; or to (b) protect and defend the rights of MyDayDayBelgium and the rights of the users of the Website.
4.6 Where Personal Data can be aggregated and anonymized by removing the personally identifiable information such as the name and e-mail address MyDayDayBelgium can use it for research purposes without restriction. Such anonymized Personal Data may further be disclosed to third parties. MyDayDayBelgium is entitled to do this because the resulting data will not personally identify the customer and will therefore no longer constitute Personal Data for the purposes of data protection laws.
4.7 Except as otherwise provided in the present section, MyDayDayBelgium undertakes not to transfer the customer’s Personal Data to third parties without his approval.
§5 – SECURITY
To protect the Personal Data, MyDayDayBelgium takes reasonable precautions and follows industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
MyDayDayBelgium uses a variety of security technologies and organizational procedures to help protect the Personal Data. For example, access controls are implemented, firewalls and secure servers are used, and data is encrypted, such as financial information and other important data.
However, no data transmission over the internet can be guaranteed to be completely secure. So, whilst MyDayDayBelgium strives to safeguard the customer’s information, the security of any information provided by the customer cannot be guaranteed and providing Personal Data is therefore at the customer’s own risk.
§6 – TIME OF RETENTION OF PERSONAL DATA
By entering its Personal Data and/or creating a membership account the customer agrees to the data processing. MyDayDayBelgium will hold the Personal Data for as long as it is necessary for the execution and the follow-up of the Order. This will usually be for two years.
On the other hand, some Data will be kept as long as is required for legal purposes (commercial and tax law), with a maximum of ten years.
In the event MyDayDayBelgium relies on the consent of the customer to contact him for direct marketing purposes, the consent of the customer will be treated as lasting only for as long as it is reasonable to do so. This will usually be for two years. It can be periodically asked to renew the customer’s consent.
If the customer asks to stop contacting him with marketing materials, MyDayDayBelgium will keep a record of the contact details and limited information needed to ensure that can be complied with the request of the customer.
§7 – RIGHTS OF EUROPEAN UNION BASED RESIDENTS
7.1 The customer that is also a European Union based resident has the right to request details of the processing activities that are carried out by MyDayDayBelgium with the Personal Data of the customer through making a subject access request. Such request must be made in writing at the following e-mail address: enquiry@mydaydaybelgium.com.
7.2 This customer also has the following rights:
- the right to access;
- the right to request rectification of information that is inaccurate or out of date;
- the right to erasure of his information (“the right to be forgotten”). However this does not include any data that MyDayDayBelgium is obliged to keep for administrative, legal or security purposes;
- the right to restrict (temporarily) the way in which MyDayDayBelgium is dealing with and using the customer’s information;
- the right to request that his information be provided to him in a format that is secure and suitable for re-use (“right to portability”).
The requests concerning these rights can be send to MyDayDayBeglium via e-mail at enquiry@mydaydaybelgium.com.
Not all rights are absolute. MyDayDayBelgium can have compelling legitimate grounds that outweigh the interests and rights of the objector (accountancy, juridical reasons,…).When a request is made, MyDayDayBelgium may demand extra information to confirm identity.
7.3 To unsubscribe from our newsletters the customer has the possibility to click on the “unsubscribe” link situated at the bottom of all the newsletters. The unsubscribe requests are taken into account only if the customer further receives a confirmation message. In the event he does not receives the confirmation message, the customer may address his request to unsubscribe to MyDayDayBelgium at the e-mail address: enquiry@mydaydaybelgium.com.
§8 – COOKIES
8.1 In addition to the information which the customer supplies to MyDayDayBelgium, information and data may be automatically collected through the use of cookies. A cookie is a piece of data (containing information of the customer) employed on the Website or application to recognize repeat users and allow MyDayDayBelgium to observe behavior and compile aggregate data in order to improve the Website and its use.
Cookies may be used to personalize the application according to the customer’s preferences. Cookies also allow the analysis of the use of the application.
Cookies also allow to count the number of unique and return visitors to the Website. Some of the third-party service providers may themselves use cookies on their own websites. MyDayDayBelgium has no access to, or control of these cookies, should this occur.
8.2 Cookies may be either “persistent” cookies or “session” cookies. A persistent cookie consist of a piece of data sent by a web server to a web browser, which will be stored by the browser and will remain valid until its set expiry date (unless deleted by the user before the expiry date). A session cookie, will expire at the end of the user’s session, when the web browser is closed.
8.3 If the customer does not wish to receive cookies from My DayDayBelgium or any other Website, he should turn cookies off on his web browser following its browser provider’s instructions to do so.
8.4 No permission is needed for the installation of cookies which have as sole purpose to facilitate the electronic communication, which are essential to the operation of the Website or which are strictly necessary to the provision of online services at the express request of the customer.
8.5 For other cookies, consent or refusal of the customer is needed and provided via the settings of his browser or via the configuration of any other technical mean dealt via the application and allowing MyDayDayBelgium to manage the customer’s navigation with the application.
8.6 MyDayDayBelgium cannot accept liability for malfunctioning of the device of the customer or its installed web browser because of any attempt to turn off cookies. MyDayDayBelgium informs the customer that disabling cookies may be detrimental to the optimum navigation and to the functionalities of the Website.
8.7 The customer can always delete the accepted cookies. In the event he wishes to delete cookies, the parameters and the preferences which are controlled by the concerned cookies will also be deleted.
§9 – CHANGES TO THIS PPS
MyDayDayBelgium reserves the right to modify and change the PPS at any time without notice. Any changes to this PPS will be published on the Website and effective immediately on the date of posting. It is the responsibility of the customer to review this website periodically to understand any revisions to this PPS. The continued use of the website by the customer after the effectiveness of such revisions will constitute his acknowledgment of the revised PPS.
